Katy Perry 'Witchcraft,' Kendrick Lamar Sampling Spark New Copyright Lawsuits

A Christian hip-hop artist targets Perry over "Dark Horse" while the owner of a song by The Alan Parsons Project goes to court against Lamar.

Katy Perry and Kendrick Lamar are both facing new lawsuits claiming they've misappropriated songs in hit releases.

Katy Perry
The copyright action targeting Perry in Michigan federal court is the one that's most entertaining. It comes from Christian rapper Flame (born Marcus Grey) and his producers, who say they authored a 2008 gospel hip-hop song entitled "Joyful Noise." That song appeared on an album that was nominated for a Grammy for best rock or rap gospel album.

According to the complaint, the song was used without permission in the creation of Perry's "Dark Horse," the first single from her 2013 album, Prism. The plaintiffs don't go into much detail about how it was used, but the defendants — which include producer Dr. Luke and Capitol Records — are alleged to have damaged the plaintiffs in the creation and performance of a chart-topping song.

"By any measure, the devoutly religious message of 'Joyful Noise' has been irreparably tarnished by its association with the witchcraft, paganism, black magic, and Illuminati imagery evoked by the same music in 'Dark Horse,' " states the lawsuit filed on Tuesday. "Indeed, the music video of 'Dark Horse' generated widespread accusations of blasphemy and an online petition signed by more than 60,000 demanding removal of an offensive religious image from the video."

Meanwhile, over in California federal court, acclaimed rapper Kendrick Lamar is being accused of improper sampling on "Keisha’s Song (Her Pain)."

The plaintiff in the case is Woolfsongs Limited, a U.K. company that manages the works of Eric Woolfson and his platinum-selling music group, The Alan Parsons Project. Woolfsongs asserts that "Keisha’s Song" incorporates the group's song "Old and Wise" without consent.

The complaint says that resolution of the matter was attempted with Lamar's reps in April 2014, but no settlement resulted and the defendants became unresponsive.

Both lawsuits demand injunctions. The Perry lawsuit seeks profits and statutory damages while the Lamar lawsuit aims for an award of compensatory damages.

The label also announced the elevation of Mark Pinkus to president, U.S. catalog and Rhino Entertainment from his current post as Rhino's SVP of sales and marketing. Pinkus will report to Fraser-Harding, who in turn will report to WMG CEO Steve Cooper.

"Tim has done an exceptional job in energizing our catalog business around the globe," said Steve Cooper in a statement, "driving a fantastic release schedule that has expertly mined our rich legacy, supported by a series of creative, highly successful campaigns." Cooper went on to thank Kevin Gore for his 12 years spent at the company.

Warner Music corporate has been relatively under-the-radar this year, striking a partnership with Shazam for access to the music identification app's proprietary data, giving it a window into what Shazam's purported 420 million users tag with the service.

The company also began divesting some of its assets in March to meet a deal the label made with Merlin and IMPALA over its acquisition of Parlophone for $765 million. That deal had a part in the downgrading of Warner Music's corporate family debt rating by Moody's following its debt refinancing arrangement in March.

Tyler Perry Wins 'What Would Jesus Do' Trademark Battle

His opponent at the Trademark Office was a reality TV star who registered first and claimed she had introduced him to the title of a proposed show. She still lost.

Tyler Perry -H 2014

While not scripture of ecclesiastic precept, the United States Patent and Trademark Office has declared Tyler Perry to be the winner in a battle over "What Would Jesus Do."
The other contestant in this bout was Kimberly Kearney, who was once known as "Poprah" on the VH1 series, I Want to Work for Diddy.

In May 2008, Perry registered the mark in the category of entertainment services, mentioning in his filing live concerts, a TV program and motion pictures. He included a disclaimer that he wasn't attempting ownership on the exclusive right to use "Jesus" apart from "What Would Jesus Do."

However, months earlier, Kearney had already filed for that same mark for a reality television program.
When her "What Would Jesus Do" mark was then published for opposition two years later, Tyler Perry Studios stepped forward to cancel it. Although Kearney had included in her registration a print-out of a web page calling for auditions on her show, Perry's reps said that she wasn't really using the mark. Perry demanded that the Trademark Office declare her registration abandoned as it was blocking his own attempts to turf out "What Would Jesus Do."

EXCLUSIVE//: How Business Managers Handle Money...

In subsequent papers at the Trademark Trial and Appeal Board, Kearney attempted to make the case that she first used the mark in November 2007, and during the initial stage of production, she "shared her television program and title with Tyler Perry Studios" and that "not many months after sharing this program and soliciting [Perry] for financial support of this program, [Perry] filed to register this mark; consequently, eventually resulting in this cancellation proceeding."

But that hardly mattered thanks to some trademark jujitsu on the part of Perry's attorneys.
They requested the admission of certain facts by Kearney -- that she admit she hadn't produced a television show in connection with "What Would Jesus Do," that she hadn't sold one, that she didn't intend to do so nor had taken any meetings for such a show.

"Because [Kearney] did not timely answer [Perry]'s Requests for Admission, the facts included are deemed admitted and are 'conclusively established,'" wrote administrative judges in an opinion cancelling Kearney's trademark that was handed down last month and has just been promulgated. "Despite Respondent’s denials in her answer to [Perry's] petition, the deemed admissions supersede those denials and we are bound by them."

The judges also note Kearney's claims that Perry stole her "What Would Jesus Do" idea, but says that even if it was enough to support use or be a defense of unclean hands, "these allegations are unsupported and we may not adduce any facts from them."

If Tyler Perry does something with "What Would Jesus Do" -- and as illustrated here, he's under some onus to actually use it in commerce lest he also abandon the mark -- this is the backstory behind it.

EXCLUSIVE UPDATE --Nida and his wife Phaedra Parks convicted of cashing stolen checks, laundering more than $2 million dollars

UPDATE -- Apollo Nida, husband of "Real Housewives of Atlanta" co-star Phaedra Parks, is headed to prison for eight years on fraud charges.

Nida, who appears on the reality TV series with Parks, was arrested in January and pleaded guilty in May to charges in a fraud scheme that federal prosecutors say stole millions of dollars from at least 50 people over four years.

A hearing on July 17 will determine how much restitution Nida must pay to his victims.

Nida, 35, must serve five years under parole supervision after he completes his eight years in a federal prison, U.S. District Court Judge Charles A. Pannell, Jr. ordered during sentencing Tuesday.

It will be the second prison stint for Nida, who previously served five years in a federal prison for auto title fraud before marrying Parks in 2009.

Nida created two fake collection companies to gather personal information used to steal victims' identities, U.S. Attorney Sally Quillian Yates said after his sentencing in Atlanta. He used the information to get fraudulent auto loans in the names of his victims, according to the criminal complaint.

"Today's sentencing exemplifies impartial justice regardless of economic class or perceived celebrity status," U.S. Secret Service Special Agent Reginald Moore said.  "Nida's sentence should be an eye-opener for other like-minded criminals who scheme to steal victims' identities, defraud them and ignore the consequences of their actions."

News Flash--Amber Rose Buds Up W/ Nick Cannon

The break in the case came in September, when federal investigators arrested Gayla St. Julein, a woman who "described herself as Nida's 'right hand b****' in executing the legwork of his fraud schemes," the complaint said.

St. Julien, who previously served prison time for identity theft, told agents that Nida "only paid her 'scraps'" for her work, compared to the amount of money he made from the fraud schemes," the filing said.

She turned on him and agreed to let agents record their phone calls, it said.

Nida "knowingly and willfully (did) execute and attempt to execute a scheme to defraud federally insured financial institutions by depositing stolen and fraudulently obtained checks and fraudulently obtained auto loan proceeds into bank accounts opened in the stolen identities of real persons, and conspire with others to do so, and knowingly convert to his use and the use of others stolen and fraudulently obtained United States Treasury Checks," Special Agent Alexandre Herrera said in a sworn affidavit.

Nida's fake companies fraudulently signed up with "LexisNexis, Equifax, and Mircrobilt databases" to steal personal information on people.

Along with the fraudulent auto loan checks, Nida stole U.S. Treasury checks, "retirement checks issued to Delta Airlines employees, and checks in the names of real people that were owed unclaimed property from various state and federal government agencies," the complaint said.

NEWS FLASH: SoundCloud nearing deal with majors...

Agents recorded phone calls St. Julien made to Nida during which he discussed details of pending fraudulent auto loans and "details of future auto loan checks that he was expecting to receive any day now from in the mail," the affidavit said.

Nida and his wife  Phaedra Parks  convicted of cashing stolen checks, laundering more than $2 million dollars through phony bank accounts.

Nida and his wife of several years Phaedra Parks (who is also a cast member of the Real Housewives Of Atlanta) were reportedly convicted of cashing stolen checks, laundering more than $2 million dollars through phony bank accounts. Due to spousal privilege, Phaedra was granted immunity in testifying against her husband. It was reported that Nida begged a judge to lower his sentencing.

His lawyer was quoted as saying, "Mr. Nida’s lengthy but early small-time criminal history is simply not in the same league as the “violent offenders, drug kingpins and perpetrators of far more serious offenses” that Criminal History Category V was designed to address.”

Garth Brooks' July 7 news and Dublin's LVA condemns Councils' shows refusal

Country Music Examiner -

Dublin, Ireland may not be prepared for the “power of Garth Brooks,” but fans are hoping for the announcement from Garth, for more music, more U.S. tour dates and a World Tour schedule on Monday, July 7, 2014.

Now, with the with The Licensed Vintners Association (LVA) stepping in, the Dublin City Council's refusal of having all five of Garth's shows at Dublin's Croke Park, may now prove to be a horse of a different color - money green. The LVA has condemned the actions of Dublin's City Council and is urging Manager Eoin Keegan to reverse his decision not to allow two of the proposed five gigs to go ahead.

This article appeared first 7/6/2014 in the
Country Music Examiner
Garth hasn't been on tour in 13 years, so fans are expecting Garth Brooks' World Tour 2014 announcement on Monday. But, before making a U.S. trek or World Tour official, the singer set a five-night "Comeback Special Event" in Ireland, July 25-29, 2014 at Dublin's Croke Park. However, the performances haven’t set well with Dublin, Ireland’s City Council, residents and businesses. However, we Garth fans seem to have friends in high places such as The Licensed Vintners Association (LVA), who is now condemning the council's refusal to allow two final shows.

Garth Brooks' hiatus began in 2001 for the honorable commitment to a more important job as “Dad”. He vowed to stay home in Oklahoma with his three daughters and wife Trisha Yearwood until his youngest graduated from high school this past May. On his website July 3, 2014, Garth Brooks posted that "the wait is over" along with the enticing date of July 7, 2014 as a hint at a big announcement on that day.

The performances in Dublin were to include five concerts at Dublin's Croke Park sports stadium. Now, his concerts have been abruptly shortened by the Dublin City Council on Thursday, July 3, 2014. The council’s decision was to deny issuing licenses to Irish concert promoter, Peter Aiken of Aiken Promotions for Garth’s final two performances. The reason for the forced cancellation of those concerts is just as surprising.

Garth was scheduled to perform at the the 82,000-seat Croke Park stadium, but the Dublin City Council’s action was decided by many residents, residents’ groups and local businesses. The Guardian newspaper in London reports the city council’s reasoning, "The cumulative effect on residents and on some businesses would lead to an unacceptable level of disruption to their lives and livelihoods," the council said in a written statement.

According to CMT, in addition to the Dublin City Council’s consideration in the matter, The BBC received 373 submissions from residents, residents' groups and local businesses to halt the two performances. We fans could see this happening with a much smaller town, however, Dublin is by no means a small town and full of bustling activity, so the “unacceptable level of disruption in their lives and livelihoods” and more cited on the city council’s denial for performances “The council cited their concerns about fears of noise, traffic disruption, illegal parking and “potential anti-social behaviour,” saying their reasoning was “to minimise disruption to the neighbourhood in which the concerts are to take place”is somewhat confusing and probably a major disappointment to Garth fans in Ireland.

The sad news is that, with a total of 400,000 tickets sold for Garth Brooks’ five-night schedule, some 70,000 of the 400,000 tickets were bought by fans living abroad. Ticket holders took to social media and the national airwaves to voice their disappointment. "I queued for two days and two nights for these tickets. I'm so annoyed, it's just terrible," Carol McDonald, who had bought a ticket for the July 29 date, told a popular phone-in show on national broadcaster RTE.

The promoter, Peter Aiken, in an interview also with RTE News, Ireland's national public service media organization, said “Brooks is devastated by the decision and feels it's unfair that 160,000 people will not be able to attend the two shows.” Because of projected ticket demand, says Aiken, “two shows were initially planned in Dublin, but it was extended to five nights with a larger production…” to meet fan requests.

There may be a ray of sunshine over this whole fiasco as reported by the Independent.ie Irish News, with The Licensed Vintners Association (LVA) now urging Dublin City Manager Eoin Keegan to reverse his decision not to allow two of the proposed five gigs to go ahead.

The Licensed Vintners Association (LVA) is the trade association and representative body for the publicans of Dublin. It is one of the oldest trade associations in the country with an unbroken history tracing back to its foundation in 1817. The purpose of the Association is to represent the views of the publicans of Dublin to key stakeholders and to promote their strategic business interests.

A decision will be made by Tuesday as to whether any of the planned concerts concerts will go ahead. Brooks, meanwhile, has given an "all five concerts or nothing" ultimatum.

The LVA has said that Dublin “simply cannot afford” for the sell-out gigs not to go ahead. “This is still a very difficult economy for every business in the city and the Garth Brooks concerts promised a hugely significant financial boost for pubs and for the wider hospitality industry,” O’Keeffe, Chief Executive of the LVA said. “It is simply unbelievable that the City Manager who oversees a penal Commercial Rates and Water Charge regime for businesses in the City took the decision to cancel concerts that could help us afford the high charge regime.”

The LVA said it is “appalled” by the turn of events and estimates that the loss of the five concerts could cost Dublin pubs as much as €15 million. “This is still a very difficult economy for every business in the city and the Garth Brooks concerts promised a hugely significant financial boost for pubs and for the wider hospitality industry,” O’Keeffe, Chief Executive of the LVA said.

The GAA (Gaelic Athletic Association) and Croke Park statement was that they "note the decision of Dublin City Council in relation to the granting of a licence for the staging of three Garth Brooks concerts on Friday 25th, Saturday 26th and Sunday 27th July. We will fully assess the implication of today’s announcement and will make no further comment before Monday next, 7th July."

Brooks, who has sold more than 125 million albums and is best known for hits such as "The Thunder Rolls" and "Friends in Low Places", has played the occasional one-city run of shows and benefit concerts during his retirement but has never toured.

Sherry Jane-Cooke
If Monday's announcement will not be a long list of U.S. tour dates or his World Tour 2014, it could be about new music. Brooks' last album was the 2013 box set, Blame It All on My Roots: Five Decades of Influences, on which he covers everyone from Hank Williams to Otis Redding.

Dublin may not be prepared for the “power of Garth Brooks,” but fans are hoping for this week's Monday's and perhaps a Tuesday announcement from Garth, for more music, more U.S. tour dates and a World Tour schedule. And , were hoping for a backup from the calvary . . . an Irish calvary called the LVA.
